Dog owner fined after Akita inflicts fatal injury on ‘beloved family pet’

Mohammed Shabbir’s Akita savaged Merlin, a Collie, who later died due to complications while under anaesthetic, Kirklees Magistrates’ Court was told.

Prosecutor Miles Barker put it to magistrates that Shabbir did not have a lead on the dog before the incident in Crow Nest Park on June 26 last year.

“It is the prosecution’s case that the Akita was not on a lead at any relevant time and that Merlin, the other dog, was.”

Mr Barker said the other owner made efforts to avoid the rampaging dog, but he added: “It was lose and it went for Merlin and it stood absolutely no chance against the Akita.”

Paul Blanchard, mitigating, explained that Shabbir was pleading guilty on a limited basis – meaning that he did not agree with every detail of the prosecution’s case.

Shabbir, 39, claimed the dog was on a lead but somehow slipped it.

Regardless, the Akita bit and held onto Merlin’s rear left leg, causing serious injury.

“He had insufficient control of the dog to prevent that from happening,” Mr Blanchard said.

Shabbir, of Park Parade, Westtown, must pay £393 compensation, a £60 victim surcharge and £1,178 costs.

He must also keep his dog on a lead and muzzled at all times in public places.

A Kirklees Council spokeswoman said: “This was a tragic case that led to the death of a beloved family pet and the sentence given shows the serious view the court has taken of the offence.

“Dog ownership is highly rewarding, but also a great responsibility. Owners must make sure their dog is under control at all times and take the appropriate steps to stop their animal hurting others.”
